1. About Us
Cardgiftpayment.com is operated by VALUE FORWARD LIMITED, company number 17163549, a company incorporated in England and Wales with its registered office at Suite A, 82 James Carter Road, Mildenhall, United Kingdom, IP28 7DE. These Terms of Service ("Terms") govern your access to and use of the CardGift platform, including our website and related services (collectively, the "Platform").
By registering an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
2. How the Platform Works
CardGift is a platform that enables private individuals ("Sellers") to sell gift cards to the Company, and other users ("Buyers") to purchase gift cards from the Company. A gift card ("Card") is a digital, prepaid stored-value instrument issued by a third-party merchant or service provider, representing a specific monetary value or entitlement, which may be redeemed solely for goods and/or services offered by such issuer through its online platforms.
By registering as a Seller, you agree to sell gift cards to the Company under these Terms. By registering as a Buyer, you agree to purchase gift cards from the Company.
- Sellers submit gift card details, including the card code and desired sale price. By submitting a Card, the Seller makes an offer to sell the Card to the Company.
- The Company performs verification checks to assess the validity, authenticity, and usability of the Card. Upon successful verification and acceptance, the Company may purchase the Card from the Seller.
- The Company independently offers Cards for sale to Buyers at prices determined by the Platform. When a Buyer purchases a Card, the transaction is concluded directly between the Buyer and the Company.
- The Buyer receives the Card code and has 7 calendar days to verify that the Card is valid and unused. If the Buyer confirms validity, or takes no action within 7 calendar days, the transaction is deemed final.
- Seller proceeds are credited to the Seller's account only after the 7-day verification period has elapsed.
- If a Buyer raises a dispute within 7 days and it is upheld, the transaction may be reversed and the Seller will not receive funds for that Card.
3. Fees
cardgiftpayment.com purchases gift cards from Sellers at a discounted value. The difference between the Seller payout and the resale price includes the Company's service fee and margin. No fees are charged to Buyers. The price displayed to Buyers is the full amount they pay — there are no hidden charges or additional costs.
Example: a £100 face-value card submitted with a £75 sale price — the final payout to the Seller may be reduced by the Company's fee (7% of face value), resulting in a net amount of £69.75.
4. Seller Obligations
- You must be the lawful owner of any gift card you list.
- The card code you submit must be genuine, unused, and have the face value stated in the listing.
- You must not list gift cards that are expired, partially used (unless accurately disclosed), or obtained by fraudulent means.
- You must provide accurate retailer, denomination, currency, and region information.
- Once a Buyer purchases the card, you must ensure no concurrent sale occurs on any other platform.
5. Identity Verification (KYC)
5.1 Why we verify identity
As a payments platform operating under applicable UK anti-money laundering regulations (including the Money Laundering, Terrorist Financing and Transfer of Funds Regulations 2017), we are required to verify the identity of Sellers before releasing funds. This process is known as Know Your Customer ("KYC") and includes PEP and sanctions screening.
5.2 When KYC is required
You may list gift cards and accumulate a balance on the Platform without completing KYC. However, withdrawal of funds to your payout card requires a successfully verified identity.
5.3 What you must provide
- Government-issued photo ID — a valid national identity card or passport.
- Proof of address — a utility bill or bank statement dated within the last 3 months.
- Personal details — first name, last name, and date of birth.
- Full postal address — your current residential address.
5.4 Review process
Submitted documents are reviewed by our compliance team, typically within 1–3 business days. You will be notified by email once your KYC application has been approved or rejected.
5.5 Data retention
KYC documents are retained for a minimum of 6 years from the date of submission, as required by applicable anti-money laundering legislation.
5.6 Sanctions, PEPs, and Ongoing Monitoring
Seller accounts are subject to ongoing monitoring. All Sellers are screened against UK, EU, UN, US and other applicable international sanctions and PEP databases. We perform Enhanced Due Diligence (EDD) on Sellers identified as PEPs or those residing in high-risk jurisdictions. We reserve the right to request Source of Funds (SoF) or Source of Wealth (SoW) documentation where necessary.
5.7 Suspicious Activity Reporting
We are legally obligated to report any knowledge or suspicion of money laundering or terrorist financing to the relevant UK authorities (such as the National Crime Agency). We are unable to inform you if such a report has been made.
6. Buyer Rights and Cancellation
Upon purchasing a Card, the Buyer receives the card code and has 7 calendar days to verify it is valid and unused. If the Buyer raises a dispute within this period and it is upheld, the Company will provide a full refund of the purchase amount.
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you may have a right to cancel a digital content purchase within 14 days. However, by proceeding with a purchase and receiving the card code, you expressly consent to immediate delivery and acknowledge that your right to cancel is lost once the code has been delivered, in accordance with Regulation 37. This does not affect your right to raise a dispute within the 7-day verification window if the card is found to be invalid or unused balance is materially different from stated.
7. Disputes
If a Buyer raises a dispute within 7 days, our support team will review the evidence from both sides. Decisions are typically made within 48 hours. Fraudulent sellers are banned and their listings removed. If a dispute is upheld in favour of the Buyer, the full purchase amount is refunded.
For disputes not resolved through our internal process, you may refer the matter to relevant consumer dispute resolution bodies or the courts of England and Wales.
8. Prohibited Activities
- Listing gift cards obtained through fraudulent, illegal, or unauthorised means.
- Attempting to manipulate prices, reviews, or the verification process.
- Using the Platform for money laundering, fraud, or any other illegal purpose.
- Creating multiple accounts to circumvent bans or KYC requirements.
- Listing cards for brands or denominations that do not match the submitted code.
9. Platform Availability and Changes
We reserve the right to modify, suspend, or discontinue any part of the Platform at any time. We will endeavour to provide reasonable notice of material changes. Continued use of the Platform following changes constitutes acceptance of the updated Terms.
10. Limitation of Liability
To the maximum extent permitted by law, cardgiftpayment.com shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the Platform. Our total liability shall not exceed the amount paid by you in connection with the specific transaction giving rise to the claim.
11. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
